KMAP BULLETIN: HCBS Background Check Policy

Effective January 1, 2019, new requirements went into effect for conducting Home and Community Based Services (HCBS) background checks and for allowing provisional employment. HCBS background checks continue to apply to all HCBS providers including Targeted Case Managers (TCMs).
The HCBS policy details the checks that are required before an employee, paid or unpaid, can provide services to an HCBS waiver participant. The policy also details what checks must be completed before an applicant can be provisionally employed.
Biennial background checks remain unchanged from previous guidance. Medicaid funds cannot be used to pay a provider until confirmation of clear background check is received in accordance with 1915(c) waivers.
