KMAP BULLETIN: HCBS PCS in Congregate Settings Exempt from EVV Requirement

Effective with dates of service retroactive to December 3, 2023, the Home and Community Based Services (HCBS) Physical Disability (PD) and Frail Elderly (FE) Personal Care Services (PCS) provided in a licensed assisted living, residential health care, home plus, or boarding care facility will be exempt from the Electronic Visit Verification (EVV) requirement. PCS provided in congregate settings are currently identified by using S5125 UA for HCBS/FE.

For agency directed PCS on the HCBS/PD waiver, EVV is not required for S5125 U9 in congregate settings for service dates December 3, 2023, through March 31, 2024. Instead, beginning with dates of service on and after April 1, 2024, HCBS/PD will use S5125 UA for PCS provided in congregate settings, which is exempt from EVV requirements. Reimbursement for S5125 UA will be the same as agency directed HCBS/PD PCS (S5125 U9), currently $4.55 per unit.

Note: The effective date of the policy is December 3, 2023. The implementation of State policy by the KanCare MCOs may vary from the date noted in the KMAP bulletins.
